Terms of Service
These terms govern your use of dusto during early access. Dusto is provided as is; we may make breaking changes, and pricing and features may evolve. Read this in full before relying on dusto for anything that matters.
The company you're contracting with.
Dusto is operated by Spicadust Inc., a Delaware C-corporation. "We," "us," and "dusto" refer to Spicadust Inc. "You" refers to the individual (aged 16 or older) using the service.
What dusto does.
Dusto is an email intelligence layer. You forward email to a @dusto.app address; an AI agent reads it and sends digests, alerts, and drafted replies to a verified destination address.
The agent runs on third-party large language models (currently xAI / Grok). Its output is best-effort: it can be wrong, miss context, hallucinate, or pick the wrong template. Do not rely on dusto for time-critical, financial, medical, legal, or safety-critical decisions. Always verify important emails directly.
What 'early access' means here.
Dusto is in early access. We may change features, adjust pricing, or shut down individual capabilities. We'll give reasonable notice for material changes. We do not offer service-level agreements during early access.
Who can use dusto.
You must be at least 16 years old, not on a sanctions list, and not located in a sanctioned region (currently Cuba, Iran, North Korea, Syria, and the Crimea / DNR / LNR regions of Ukraine; and you must not appear on the OFAC SDN list). One person per account.
What you agree not to do.
No illegal content. No spam — you are responsible for ensuring you have permission to forward any mail you direct to dusto. No scraping, no reverse engineering, no abusing rate limits.
Per-account rate limits apply (default approximately 100 requests per minute, with tighter limits on send and export). We may tune these limits as we operate the service.
We may suspend or terminate your account for breach.
How we charge.
There are two ways to use dusto:
- Pay-by-use — $0/month, with $5-minimum top-ups via Stripe. Auto-reload is optional.
- Subscribed — $10/month, including a $3 weekly grant that resets every 7 days. The grant does not roll over.
New accounts receive a one-time $2 signup credit on first creation.
Usage is metered by total LLM tokens consumed and converted to dollars internally; you only see dollars on your dashboard.
Billing is handled by Stripe; their terms govern the handling of card data.
Subscriptions auto-renew until cancelled. We do not offer refunds for partial months. Cancellation is effective at the end of the current Stripe billing period; the weekly grant is cleared immediately on cancellation. Top-up balance survives cancellation until used or until you delete your account.
We may adjust pricing with 30 days' advance email notice.
The agent is fallible.
The agent may hallucinate, miss emails, choose the wrong template, or over-consume your balance and stop mid-run. Final responsibility for acting on dusto's output is yours. Treat it as a smart but fallible assistant.
What happens when you leave.
You can delete your account from the dashboard via DELETE /me. Deletion is immediate and irreversible. We hard-delete your dusto records (email rows, agent traces, raw S3 mail), detach your Stripe customer, and delete your Cognito identity. There is no recovery, no grace period, and no export after deletion — export first if you want a copy.
Some operational records survive for legal and integrity reasons: Stripe-side payment records (governed by Stripe), our Stripe webhook event ledger (event IDs only, no personal data), and CloudWatch operational logs subject to standard retention.
Who owns what.
You retain ownership of your email content. You grant us a non-exclusive license to process it solely to provide the service (including transmitting it to our LLM provider).
We own dusto itself, including the platform, prompts, and the style of any agent-generated output.
Provided as is.
The service is provided AS IS during early access. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Limits on what we owe you.
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to dusto is capped at the greater of (a) the amount you paid dusto in the 12 months preceding the claim, or (b) USD $50.
We are not liable for indirect, incidental, consequential, or punitive damages, lost profits, or lost data. Some jurisdictions do not allow these limits; in those, the limits apply to the maximum extent permitted.
Your responsibility.
You will indemnify and hold us harmless from any claims arising from your misuse of the service, your content, or your breach of these terms.
Ending the relationship.
Either side may terminate at any time. On termination, the deletion provisions in §08 apply.
Where disputes are resolved.
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Venue for any dispute is the state and federal courts located in Delaware. To the extent permitted by law, you waive any right to participate in a class action against us.
When these terms update.
We post material changes to this page and email account holders 30 days before they take effect — or immediately if a change is required by law or to address a security risk.
